1. Membership Agreement
By signing up for a membership or using the facilities at The Next Level, you agree to abide by these Terms and Conditions, which form a legally binding contract between you (the member) and The Next Level, a gym operating in Worksop, Nottinghamshire.
2. Eligibility
- You must be at least 14 years old to become a member.
- Anyone under 18 must have written consent from a parent or guardian, an e-mail will be sent to each parent.
- Membership is personal, non-transferable, and non-refundable unless otherwise specified in these Terms.
3. Membership Fees & Payment
- All membership fees are payable in advance by Direct Debit, card, or cash, depending on the membership package you chose.
- Monthly memberships taken via direct debit renew automatically unless cancelled in writing at least 30 days before the next billing date.
- We reserve the right to adjust our fees with at least 30 days' written notice.
4. Cancellation Policy
- You may cancel your membership by giving 30 days’ written notice via email or post.
- If you are within a minimum term contract (e.g., 12 months), early termination fees may apply or may not be granted by the gym, this is decided at the discretion of the business.
- Cancellations due to medical reasons or relocation may be granted with supporting documentation.
5. Freezing Membership
- You may request to freeze your membership (e.g., due to injury or travel) this is however at the discretion of the gym, this must be discussed and approved.
- Freezing requests must be made in writing and are subject to approval.
6. Health & Safety
- You must complete a Physical Activity Readiness Questionnaire (PAR-Q) prior to using the gym.
- You confirm that you are in good health and fit to exercise. Consult a doctor if unsure.
- Members use the facilities at their own risk. We are not liable for injuries unless caused by proven negligence. A waiver should be completed for anyone accessing the facility.
7. Gym Etiquette
- Appropriate gym attire and clean footwear must be worn.
- Respect other members and staff at all times. No abusive, discriminatory, or antisocial behaviour will be tolerated.
- Use of equipment must follow instructions and hygiene rules. Please clean equipment after use.
8. Personal Belongings
- We do not accept responsibility for lost, stolen, or damaged items.
- Unclaimed items will be disposed of after 30 days.
9. Classes and Bookings
- Class schedules may be subject to change.
- Bookings are made on a first-come, first-served basis.
- You must cancel a class at least 12 hours in advance to avoid a no-show fee.
10. Personal Training
- Personal training is booked directly with the trainer or reception.
- Missed or cancelled sessions with less than 24 hours’ notice may be charged in full.
- A deposit for booking your personal training session should be paid in advance.
11. Suspension & Termination of Membership
- We reserve the right to suspend or terminate your membership for:
- Non-payment of fees
- Breach of rules or behaviour policy
- Providing false information on sign-up
- No refunds will be issued in cases of termination due to misconduct.
12. CCTV & Privacy Policy
- CCTV is used in public areas for safety and security.
- Personal data is collected in accordance with the UK GDPR and Data Protection Act 2018. For full details, please refer to our [Privacy Policy].
13. Liability Waiver
- You acknowledge that participation in physical activity carries risks. The Next Level will not be liable for injuries, illness, or damages unless caused by our negligence or breach of duty.
14. Changes to Terms
We may revise these Terms from time to time. You will be notified of any material changes via email or displayed notice in the gym.
15. Governing Law
These Terms and Conditions are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England.
